Shipping
You must be 21 years of age to order or receive alcoholic beverages from The Spanish table. By placing an order, you certify that you are 21 years of age. All shipments containing alcoholic beverages require an adult signature and will be shipped with an “Adult Signature Required” sticker. The common carrier that delivers our merchandise is required to ask and check for identification upon delivery.
We try and ship all orders at the beginning of each week in order to have them arrive before the weekend. This is especially true for those taking longer than three days to arrive via UPS Ground and for extreme weather conditions. Therefore the result may be that the shipment does not go out the day the order is placed. This is because we have no control over the temperature conditions once your shipment has left The Spanish Table. The result may be that your shipment doesn't go out the day that you place an order. The Spanish Table assumes no liability for any wine damaged due to poor weather during transport. This can include leakage, freezing or corks pushed out of the neck. The customer assumes all liability for the wine once it has been picked up by the common carrier. Be sure that weather conditions are suitable before shipping and pick the proper shipping method (Ground, 3-day, 2-day, etc) based on your location. All orders are shipped from our Berkeley, CA location. The Spanish Table will hold orders upon request due to weather conditions, please contact us to make arrangements as necessary. We want you to receive your shipment in the same condition it left our store, so that it can be enjoyed properly.
Our shipping prices are actual UPS cost and the cost of packaging materials. The first $100 in value is covered by UPS, but anything above that requires additional insurance. We highly recommend getting the additional insurance to protect your purchase. It is calculated at a rate of $.65 per $100 (or fraction thereof) with a minimum fee of $1.95. These are UPS declared rates. The insurance will cover the shipment if it is damaged by the common carrier. It does not cover weather related damage.
All wine is sold in California, and the title passes to the buyer in California. Customer is solely responsible for shipment of wines. Unless you instruct us otherwise, you agree that we shall arrange, on your behalf and responsibility, shipment with a common carrier to make the delivery. Non-California residents are responsible for determining whether they may lawfully import alcoholic beverages into their state. Each state has its own rules regarding alcoholic beverages. You may want to check with the appropriate agency in your state or county, before placing an order with The Spanish Table. We make no representation relative to your right to import wines into your state or county and the buyer assumes all risk with regards to this. If a buyer lives in a state where the direct shipment of wine by The Spanish Table violates the law, we suggest that the buyer provide an alternative address in another state or have their wine shipped to a third-party storage facility in a direct shipping-friendly state. By placing an order, the customer warrants that they are aware of and in compliance of the laws governing said shipment into their area.
We reserve the right to determine the propriety of shipping instructions and may refuse to ship if we deem it inappropriate or unsafe. If shipment is returned for any reason other than the Spanish Table's error, the customer must pay any additional shipping required.
Terms
The Spanish Table makes every effort to purchase wines that are in top condition. We do not accept questionable goods. Regarding older and rarer wines, it is industry standard and The Spanish Table’s policy that wines that are more than 7 years old are purchased at the buyer’s risk.
It is against California law for the Spanish Table to return or exchange surplus alcohol purchases. Within 30 days of purchase we will gladly replace, exchange or give in store credit for any bottle deemed corked. Please contact us for instructions on returning the wine before shipping. The buyer is responsible for all return shipping charges. The Spanish Table is not responsible for spoilage of wine due to weather conditions or damage done by the common carrier and can not accept refund requests for any such damage.
